This letter to you is in response to
a letter from Governor
1. Baldacci, that letter is attached to this letter for your
review. The Governor
has asked me to ask you for help in
trying to resolve this problem.
2. The problem is as follows.
On February 23, 2004 I blew the whistle on Jeff
Kobrock City
Manager of City of Gardiner in a certified documented letter to
3. Mr. Orman Withcomb, Director Department of Economic and
Community
Development, 59 State House Station,
Augusta, ME 04333-0059.
4. This letter states specific wrong doing and allegations of
HUD Fraud.
5. What
the city of Gardiner did was to enact rules after the fact to
disqualify
my eligibility to receive Government
HUD money to fix my home that is very
badly needed and may collapse if not
repaired.
6. The complaint letter was addressed to Orman Withcomb about
this problem
about Gardiner committing these acts.
Orman Whitcomb could not find any
documents of wrong doing and so could not
take any action against the city
and of course the city denied any wrong
doing,
7. I did find the official city documents that prove without
question the city did
in fact enact rules after the fact to
disqualify one individual , that
individual is
me.
8. This is just the beginning of the problem with City of
Gardiner. On April, 15
2005 I applied for a plumbing permit, to my surprise on April ,22 2005.
9. The city of Gardiner refused to
issue it, citing a memoranda issued by Jeff
Kobrock and dated June, 10 2004, it says no permits, licenses
or
authorizations of any type shall be issued to
anyone owing the city any money.
10. Now the interesting thing about this whole thing is that
plumbing permits
have to do with health and safety, after all where are
you going to go to the
bathroom if you cant fix your toilet?
11. And also it is illegal, it is
against state law, to make matters worst the city
of Gardiner sent the Gardiner Police
out to my car to explain to me
about
Gardiner’s rules about issuing
plumbing permits.
12. What exactly do police have to do with plumbing
permits? Exactly nothing,
so what is the reason, some threat
maybe? No, I had already left and was on
my way
home when the police approached me, guess what?
13. The whole thing was recorded on
a digital recorder, from beginning to end,
I can send you a copy, no reason whatsoever except to use the
law to
intimidate and to enforce illegal rules.
14. As it turns out I called the state inspector and he made
them issue
the permit.
15. First they made an illegal rule after the fact to deny me
my housing
money, then after I complain about that
they deny me a plumbing permit also
illegal and send the cops after me to boot
without any justification for
doing so, I can prove it, it was
recorded.
16. Now keep in mind that the city did in fact issue me a
building and plumbing
permit to start my project on October 25,
2002 before I complained about the
wrong doing on February 23, 2004
17. The fact is permits were issued before and not after I
filed complaints
against Jeff Kobrock, lo and behold Jeff
Kobrock has issued a rule against me
after I complained about him.
18. He says I owe the city taxes and this is the part where
you’re going to
realize that there is a real big problem.
19. If you check the city tax records you will find the
following. The tax amount
for the current year is $566.00; this is what I owe for property
taxes for the
current year.
20. If you inquire about what I paid to the city you will
discover that I paid
$1,600.00 in 2005, I paid $1,511.76 in 2004, I paid about $1,600.00 in 2003.
21. Going by these city tax records I paid 3 times what the
property is worth
because my home was accessed at 3 times the
value, my tax evaluation came
down after I recorded the tax assessor
and told him about it.
22. Your next question is going to be why didn’t you
complain? Why did you
pay this amount? The answer is The city threatened me, I did complain to the
previous previous
tax assessor ,do you know what he told me?
23.“If your house is as bad as you
say it is, then we will condemn your
house
and kick you out”
24. I swear to god it is true and I would say it under oath
and penalty of perjury.
25. If you had seen my house and the condition that it is in you would
keep
your mouth shut and say nothing, because
to do otherwise would land you
and your family in the street, that’s
why.
26. The city has an enormous amount of power and they can and
would have
done it, so under threat I said nothing.
27. However when the city under the direction of Jeff Kobrock
denied me
money to fix my home that the Government gave them for the purpose,
they
made rules after the fact, the only
person that this rule affected is me.
28.They said you owe us money,
you cannot qualify for this housing
program,
I paid the city 3 times what the property is worth, 3 times,
check the record.
29. I have had enough, I can’t take it anymore, I may end up
losing my home
because I can’t get permits to fix it.
30. It is not only unfair, it is illegal.
31. According to the Governor Baldacci letter MRSA 2607
Neglect of Official
Duty there is a fine for breaking this law for each offence,
they did it several
times and the problem is far worst then
you think it is.
32. On November 23, 2005 I applied to the city of Gardiner for
demolition and
building permits, part of my building is so
bad it needs to be torn down
causing health and safety risk and the rest
of the building needs 136 feet of
foundations to be replaced, repair of this
building is not optional or cosmetic,
it is mandatory, health and safety
risk will result if not repaired and me and my
family will have no place to live.
33. If you think I am exaggerating about the condition, Come
and look at it
yourself and you tell me.
34. Jeff Kobrock and the city know about the condition of the
property, first
hand, it has been documented and Kobrock
admitted it in a letter he wrote to
me.
35. So what do you think the response of Kobrock is?
36. He sends over to my house Waldo Gilpatrick, his temporary
code
enforcement officer with a copy of his
memoranda dated June 10, 2004
37. Waldo says “I am just a messenger,
I have nothing to do with any of this,
Kobrock sent me over to give this to you in response to your
permit
application and then he left.
38. No concern of any kind about health and safety issues,
Kobrock knows full
well the condition of our building,
there’s no question about that, it is
documented. Without question Kobrock has
violated MRSA 2607 several
times, knowingly and intentionally.
39. In addition to this, this Kobrock has no regard for the
laws of Maine, has no
regard for the laws of Gardiner or the
health and safety either. This is where I
have a problem with this man.
40. He doesn’t care what the law says, it doesn’t apply to
him.
41. I sent certified mail, return receipt on January 2, 2006
to the Mayor Rines
and all the council members and Kobrock
and the code enforcer reapplying
and
informing
them that they are in violation of their
own city ordnance that
requires processing within 14 days and
neglecting their official duty for failing
to process my permit applications and
the fact that they have no ordnance
to
deny permits based on tax issues.
42. Do you
know what the response is?
Nothing.
43. They refuse to reply , then the
Mayor says he has an ordnance, however
when asked to produce this ordnance,
they refuse and they refuse to process
my permit applications.
44. There’s
more.
45. While looking at the Gardiner Maine website I discover
that the city enacted
an ordnance 58 days after the
fact as I applied on November ,23
2005.
therefore proving that they had no legal
right or ordnance in the first place
and in fact violated their own duties
and responsibilities of their office
which happens to be illegal according to
MRSA 2607.
46. The city of Gardiner ordnance as written does not make
any provision for
health and safety.
47. I think
it is illegal also.
48. The laws in Gardiner only apply to some people and if you
complain about
their wrongdoing they will make laws
against you and use their police to
enforce their illegal law.
49. My house is falling down around me.
50. I may lose my home because I do not have a permit to fix
it. I have kept
silent for a long time , the city of Gardiner
is corrupt when the Mayor and city
council respond to illegal actions by
making laws to protect their own illegal
actions.
51. I can’t complain to the city of Gardiner and I can’t
complain to the
police, so I am asking you on advise from
Governor Baldacci to look into this
problem
