LYING STATEMENT NO# 2 MADE BY ERIK STUMPFEL CITY OF GARDINER MAINE LAWYER "if the excavated hole collapses, it could undermine the street in front of the house, creating a hazard to cars driving by" Mr. Stumpfel the EXCAVATION HOLE is located 14 feet from the edge of the road and is only 6 feet deep, it is only 8 feet deep in the far end away from the roadway by 32 feet. The problem with the city of Gardiner has lasted 5 years. We are in our second lawsuit against the city, we currently have NO PERMITS because of the ANIMOSITY, MALICE AND RETALIATION. The city hates the Wlodylo Family for exposing them. Where in the history of the State of Maine have you ever seen anything like this? Judge Marden said this to me in open court just before he issued a protection order against the city for abusing their power of authority "I can't wrap my mind around what they are doing, I have studied case law from all over the United States and have never seen anything like it"

The DA Evert Fowle said to me on the phone "I have never seen anything like it, I am going to send your letter to the Mayor Brian Rines and see what he has to say about it, I will give them about a week to respond and if they don't call me I will call them" The DA office told me that Evert had to call the Mayor and the Mayor has refused to respond to your letter" You can see a copy of the letter yourself, click here. David P Cichowski came to work for the city in late December of 2005 after a rash of code officers had either quit or been fired. Mr. Cichowski had replaced Barbara McPeters who had inspected the wlodylo property several times and commented in her report that the Wlodylo construction was above code. McPeters also discovered that the rear deck that had been approved by the previous code officers was not in compliance with the 10 foot setback rule, however since the deck had already been approved and built, the homeowners (the Wlodylo's had a vested interest) and therefore could not be removed and also is the primary EGRESS, as the 2 family conversion building permit could not be issued without a primary egress. Mean time Waldo Gilpatrick the city backup code officer came to see the Wlodylo's as they had applied for an additional permits to continue the ongoing construction project, however instead of issueing permits to the Wlodylo's, he delivered a message from Jeff Kobrock denying the Wlodylo's permits based on Jeff Kobrock himself. Here is where Mr. Cichowski comes in

1.Mr. Cichowski sat on the Wlodylo permit application and did nothing for about 7 months mean time the wlodylo home was collapsing as the bad part of the home had to be torn down, the city code requires a decision within 14 days period, no if's ands or buts. As if this wasn’t bad enough, the Wlodylo bathroom and kitchen was located in the collapsing part of the home. It was dangerous because the Wlodylo's could not move the bathroom or the kitchen without permits. The Wlodylo's had to sue the city, it was 8 months before the city issued permits from the time of the original application, 8 MONTHS OF PERMIT DELAYS FOR NO REASON OTHER THEN ANIMOSITY.

2. There are several examples of Mr. Cichowski lying in e-mails, When Mr. Cichowski says he is concerned with the health and safety of the Wlodylo's, he is lying. The condition of the Wlodylo Home that was torn down was far worst then you can IMAGINE, THERE WAS AN OFFICAL INSPECTION CONDUCTED BY HUD OFFICIALS that was documented, there were photos taken of the condition of the Wlodylo Home, there were photos shown to Kobrock as he was suppose to be the final decision maker of the HUD rehab program, Kobrock's reaction to the photos of the desperate condition of the Wlodylo property was to LAUGH at the Wlodylo's (It was recorded on digital), nothing the Wlodylo's did could move the City of Gardiner to issue permits to demolish the bad part of the building. Not even a letter to the DA Evert Fowle himself or the Governor Baldacci

3. No compentant code officer would endanger the lives of a family under these severe conditions, Cichowski did, it is documented, it's a matter of court record.
